An Attempt to Gag

Dolphin Special Care
don’t like people telling it like it is.

This is the scanned text of Dolphin’s letter to me of June 2nd.:

Further to recent communications regarding the above and in particular to your letter dated 13th April:

Firstly, I would like to apologise for the delayed response.

It is the company’s desire to seek closure and I believe it is in all of our interests to do so.

It is on this basis that the company are willing to waive the outstanding balance, subject to you agreeing the following:

(a)  To permanently remove all references to the Company or to any work carried out by the Company or its agents or representatives at ~ (“The Property”) from the website “dooyoo.com” and from any other website or online content under our control; and

(b)  Not at any time hereafter whether on our own account or acting by agents, servants or otherwise to refer to the work carried out by the Company, its agents or representatives at the Property on any website, online content or in any other form of literature or materials prepared by or on behalf of ourselves; and

(c)  Not to divulge any information relating to the circumstances surrounding the Contract, the contents of this Agreement and of the correspondence passing between ourselves and the Company arising out of the Contract; and

(d)  To accept the terms of this Agreement in full and final settlement of any claims that you may have against the Company arising out of the Contract;

(e)  Not to make or publish any statement or comment or to act in any way in relation to the Company, its holding company, their respective officers, employees or independent sub-contracted fitters that is intended to or that may damage or lower either’s reputation or cause or authorise any third party to do so.

I couldn’t accept this: doing so would have saved me some money, but would have let down all the people who have since seen this site and been saved from Dolphin’s brand of Special Care.  In the end, Dolphin waived the bill, accepted and paid my counter-bill (for costs) and agreed that neither credit was payment for this site to come down.
And so it’s still here, speaking the truth.
