Eco Halo Conditional Planning Permission

PLANNING DECISION Conditional planning permission was given by the Planning Services Committee of the Royal Borough of Kensington and Chelsea on 13th November 2002

CONDITIONS & REASONS FOR THE IMPOSITION OF CONDITIONS:

1.  The structures hereby permitted shall be retained for a limited period only until 13/11/07 on or before which date the structures shall be removed and the land restored to its former condition.
Reason - There is insufficient evidence available at this stage to assess the impact of the development, and permission for a limited period will allow the authority to reassess the development in the light of experience and in the light of changing circumstances.

 2.   Full particulars of the following shall be submitted to and approved in writing by the Executive Director, Planning and Conservation before the development hereby permitted commences and the development shall not be carried out otherwise than in accordance with the details so approved:

 (a) the degree of illumination of the halos, to include any screening of sections of the halo with an assessment of the light emission in relation to nearby residential properties

 (b) the programme of light change to include the colour, pattern and speed of the changing colours of the halos

 (c) detailed plans to show the position of the columns on the footway in relation to other street furniture and the road line

 (e) full details of materials and detailed design of the columns

 (d) structural engineers report providing a full assessment of the stability of the structure, to include a detailed risk assessment dealing with the failure of a supporting post from vehicular collision.

 (e) the number and diameter of supporting cables including the positions of any additional supporting cables.
Reason - The particulars hereby reserved are considered to be material to the acceptability of the development, and the Local Planning Authority wishes to ensure that the details of the development are satisfactory. (RO1 1)

 3.  The illuminated halos hereby approved shall not be illuminated between 24.00 hours midnight and 07.00 hours the following day.
Reason - To safeguard local visual and residential amenity.

 4.  The halos and all supporting structures hereby approved, shall be removed and the land restored to its former condition within a calendar month, if the halos are not illuminated for a period of three months or more.
Reason
- To safeguard local visual amenity.

 5.   The illumination of the halos hereby approved shall not at any time be intermittent. (C404)
Reason - To safeguard local visual and residential amenity and to prevent the distraction of road users in the vicinity. (R404)

6.   No advertisement shall be displayed on the structures hereby approved.
Reason
- To safeguard local visual amenity

 7.  This planning permission only relates to the two light halos, each with three supporting columns and stainless steel threads and not to any other works shown on the approved drawings.
Reason - No other works have been considered as part of the application.

8.   No works shall commence until a programme for the rationalisation of street furniture at these junctions, to include a time scale for its implementation, has been approved in writing by the Executive Director of Planning and Conservation.
Reason - To prevent the accumulation of street furniture and clutter.

INFORMATIVES

 1.    Conditional Planning Permission is hereby granted for the development as shown on the approved drawings. Any alteration to the approved scheme, resulting from the requirements of the Building Regulations, the Highways Licence or for any other reason, may require further permission. You are advised to consult the Directorate of Planning Services before work commences if this is the case. (109)

 3.   The development hereby permitted must comply with the Highways Act 1980. The Directorate of Transportation and Highways, Room 230, Town Hall, Hornton Street W8 7NX (020-7361-3628) should be consulted. (124)

 4.   You are advised that a number of relevant policies of the Unitary Development Plan were used in the determination of this case, in particular, Policies CD25,CD25a, CD52, CD53, CD54, CD87, CD88, CD89, TR21 and TR39. (151)
